1. ACCEPTANCE OF TERMS
Welcome to DailyMentor.co (the "Platform"), operated by Daily Mentoring Pty Ltd ("we," "us," or "our"). By accessing our website, watching our content, or purchasing our educational products, you agree to be bound by these Terms of Service ("Terms").
If you become a paid member of our Private Network, your membership will also be governed by the specific Private Network Member Agreement signed upon enrollment. In the event of a conflict between these Terms and your Member Agreement, the Member Agreement shall prevail.
2. EDUCATIONAL NATURE OF SERVICES
(a) No Professional Advice: You acknowledge that our Services, including all content, mentoring, and community discussions, are for educational and informational purposes only. We are not financial advisors, legal counselors, or tax accountants. (b) General Guidance Only: Any advice provided by mentors is based on their personal experience and general industry standards. It has not been independently verified and may not suit your specific business circumstances. You are responsible for obtaining your own independent professional advice (legal, tax, financial) before making business decisions.
3. EARNINGS AND RESULTS DISCLAIMER
To ensure full transparency and compliance with Australian Consumer Law and FTC guidelines: (a) No Guarantee of Results: We do not guarantee that you will achieve any specific financial results, revenue, or profit. (b) Revenue vs. Profit: Any financial figures referenced on this Platform (e.g., "$10k/month" or "$100k Store") refer to Gross Revenue or Total Sales unless explicitly stated otherwise. Gross Revenue does not account for costs such as advertising, Cost of Goods Sold (COGS), software subscriptions, or taxes. A business with high revenue can still result in zero net profit or a financial loss. (c) Results Not Typical: Testimonials, case studies, and "wins" shared on this site or in our ads are from high-performing clients who applied the training diligently. They are not typical. The average person who consumes online educational content achieves little to no financial results. (d) Risk Warning: Building an e-commerce business involves significant financial risk. You should only invest capital you can afford to lose.
4. REFUND POLICY
(a) General Policy: Due to the digital nature of our content, all sales are final unless otherwise stated. We do not offer refunds for "change of mind." (b) Action-Based Guarantee: Certain offers may come with a specific "Action-Based Guarantee" (e.g., "Launch your store or get your money back"). To claim a refund under such a guarantee, you must meet the strict proof-of-work requirements detailed on the checkout page (e.g., proof of ad spend, store completion, and strategy implementation). (c) Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies your rights under the Competition and Consumer Act 2010 (Cth). If our services are unfit for purpose or significantly different from what was described, you may be entitled to a remedy under the Law.
5. USER CONDUCT & COMMUNITY STANDARDS
If you access our private communities (e.g., Skool, Slack, Discord), you agree NOT to: (a) Solicit or Poach: Contact other members to sell them third-party services, software, or coaching. (b) Harass or Bully: Engage in disparaging, abusive, or menacing behavior towards members or staff. (c) Share Accounts: Share your login credentials with any third party. Violation of this clause may result in immediate termination of your access without refund.
6. INTELLECTUAL PROPERTY
(a) Our IP: We own all rights, title, and interest in the Platform, the educational content, the "Daily Mentor" brand, and all materials provided to you. You are granted a limited, non-transferable license to use these materials for your personal learning only. (b) No Sharing: You may not record, copy, redistribute, or resell our course materials or mentorship calls. (c) Your Feedback: If you provide feedback or suggestions, we may use them to improve our products without any obligation to compensate you.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Daily Mentoring Pty Ltd shall not be liable for: (a) Any indirect, special, or consequential loss (including loss of profit, revenue, or data); (b) Any loss arising from your reliance on information provided on the Platform; (c) Any technical disruptions or downtime. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
8. SUBSCRIPTION & CANCELLATION
If you are on a recurring subscription plan (outside of a fixed-term contract): (a) Cancellation: You may cancel your subscription at any time by emailing membership@dailymentor.co at least 5 business days before your next billing date. (b) Effect of Cancellation: You will retain access until the end of your current billing cycle. No pro-rata refunds will be issued for partial months.
9. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia. You explicitly agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms.
